EUDR Implementation Delayed for Second Time

CoffeeNetwork (New York) – While no official announcement has been made at the time of writing, local news sources have reported that the European Commission will be once again delaying the implementation of the European Union Deforestation Regulation (EUDR). According to reports, the delay was caused by technical issues.

The law was first proposed in 2021 as part of the EU’s ambitious Green Deal climate law.

Last December, the European Commission postponed its implementation by 12 months to the end of this year.

Comments on the delay have already begun circulating. The WWF (World Wildlife Foundation) called the move “embarrassing” saying it would lead to “massive stranded costs for all those companies already invested in compliance, and to a loss of face of Commission President Von der Leyen.”

“It is probably no coincidence that this move comes right as the Commission pursues an unprecedented deregulation agenda, throwing the EUDR under the bus. This is unacceptable and a massive embarrassment for President Von der Leyen and her Commission. If this technical issue is real, this shows not only incompetence, but also a clear lack of political will to invest sufficiently in a timely implementation of the EUDR,” said Anke Schulmeister-Oldenhove, Forest Policy Manager at the WWF European Policy Office. 

The WWF said on their website that there is a real danger that the proposal of a delay would lead to further weakening of the law with devastating consequences for forests worldwide. The EUDR has been targeted by conservative and far-right political groups at the European Parliament, along with several national governments, pressuring the European Commission to "simplify" the EUDR, arguing that the current agreed rules “too difficult” to meet.

On the other hand, the European Parliament Group, the largest political group in the European Parliament with 188 Members from all EU Member States, welcomes the plan to postpone the entry-into-force of the Deforestation Regulation.

“This clearly shows that the problems of the Deforestation Regulation run deep. A key step in a necessary revision of the deforestation regulation is the introduction of a zero-risk category. Regions and products that pose no risk of deforestation must be treated in an unbureaucratic manner and without additional documentation requirements. Only in this way can the regulation have a targeted effect without burdening those who can demonstrate that they operate in a sustainable and responsible manner,” says Christine Schneider MEP, the European Parliament’s lead negotiator on the file.

“I will continue to advocate that the burden of proof for deforestation-free products should lie exclusively with the first distributor on the European market, as this will protect forests where deforestation is actually a threat. It is unacceptable for European forestry and businesses to be hampered by unnecessary documentation requirements while the actual causes remain untouched,” Schneider adds.
